Welcome to Magnolia Megan. These Terms of Service ("Terms") govern your use of our website at magnoliamegan.com, our free email newsletter (Club Magnolia), our paid membership (Club+), and any related content, services, or features (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who Can Use the Services

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services or purchase a Club+ membership. By using the Services, you confirm you meet this requirement and have the legal capacity to enter into these Terms.

2. Content and Information

We provide travel, lifestyle, and local business content focused on North Carolina. Our content reflects personal experiences and recommendations. We make reasonable efforts to keep information accurate but cannot guarantee that every detail (hours, pricing, availability, offerings) is current. Please verify time-sensitive details directly with businesses before visiting.

Partner offers and discounts available through Club+ membership are subject to the terms set by each partner business. We are not responsible for a partner's refusal to honor an offer, changes to terms, or quality of services provided by partner businesses.

3. Club+ Paid Membership

Club+ is a paid subscription that provides members with access to exclusive partner offers, member-only content, and additional perks. Current pricing is displayed at checkout.

Billing: Your membership automatically renews each billing cycle (monthly or yearly, as selected) until you cancel. You will be billed to the payment method you provided.
Price changes: We may change membership pricing with at least 30 days' notice. Price-locked founding members are exempt from standard price increases as described at signup.
Cancellation: You can cancel your membership at any time through your account settings or by emailing us. Access continues until the end of the current billing period.
Refunds: Refunds are handled according to our Refund Policy.

4. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of these Terms
Copy, reproduce, or redistribute our content without written permission
Share your Club+ login credentials or redistribute member-only content
Attempt to interfere with, hack, scrape, or disrupt the Services
Impersonate anyone, submit false information, or misuse partner offers
Use automated means (bots, scrapers) to access the Services or sign up for memberships

5. Intellectual Property

All content on the Services, including articles, photos, videos, design, logos, and the Magnolia Megan brand, is owned by Megan Pintell or licensed to us. You receive a limited, personal, non-transferable license to view and share content for personal, non-commercial use. Any other use requires our written permission.

If you submit content to us (such as feedback, suggestions, or photos tagged to our account), you grant us a worldwide, royalty-free license to use, display, and adapt it in connection with the Services.

6. Third-Party Services and Links

The Services use third-party providers for payment processing, email delivery, analytics, and content hosting. Our paid memberships are processed through Stripe via Beehiiv. By using the Services, you agree to the applicable terms of these providers.

We may link to third-party websites, including partner businesses. We do not control, endorse, or guarantee the content, products, or services of those third parties, and we are not responsible for them.

7. Disclaimers

The Services and all content are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any content is accurate, complete, or current.

Travel, dining, outdoor activities, and partner experiences involve inherent risks. You assume all risks associated with any activity you choose to undertake based on content from the Services.

8. Limitation of Liability

To the fullest extent permitted by law, Magnolia Megan and Megan Pintell will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Services, even if we have been advised of the possibility of such damages.

In no event will our total liability to you for all claims arising from or related to the Services exceed the greater of $100 or the amount you paid us in the 12 months before the event giving rise to liability.

9. Indemnification

You agree to indemnify and hold harmless Magnolia Megan and Megan Pintell from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or caused harm to us, other users, or third parties. You may stop using the Services at any time. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will do so.

11. Changes to the Terms

We may update these Terms from time to time. The "last updated" date at the top of this page indicates when changes were made. Material changes will be communicated to active Club+ members by email. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising from or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.
